Navigating State Greenwashing Legislation: Compliance Strategies for Marketers

As marketers await the FTC’s updated Green Guides, various states are busy enacting their own laws that aim to stem the tide of greenwashing. While state-by-state developments tend to attract less national attention than federal regulatory updates, many of these state laws have a broad reach that warrants careful attention. This presentation will cover state legislation aimed at curbing "greenwashing"— the practice of overstating the sustainability or environmental benefits of products or services.

Join us as we explore the implications of California's recent legislative efforts, including the Voluntary Carbon Market Disclosures Act, which mandates transparency for companies involved in carbon offset marketing. Participants will learn about the law's wide reach and its disclosure requirements. Relatedly, we will cover California’s Senate Bill 1036 which seeks to align voluntary carbon offset practices with California’s False Advertising Law. We will also examine legislation emerging in states including New York, Washington, and New Hampshire, much of which aims to target deceptive marketing practices related to the recyclability of plastic products.
