2025 Enterprise SMS and Telemarketing Update: Critical New FCC Rules Take Effect as TCPA Litigation Risk Spikes

2024 saw a massive increase in class litigation under the Telephone Consumer Protection Act (TCPA) and TCPA litigation is expected to spike in 2025 as new FCC rules take effect.

Following his showstopping performance at November’s ANA Masters of Advertising Law Conference, the Czar of the TCPA - Eric J. Troutman, partner at Troutman Amin, LLP - will break down everything brands needs to know RIGHT NOW about critical changes to the SMS and telemarketing rules that impact everybody in the advertising ecosystem.

First, brands can no longer buy leads unless they are individually selected by a consumer. This has massive impact for companies that buy third-party leads and warm transfers, but also for all brands collecting first-party leads - even on their own website. These rules are tricky but there are some common sense rules to keep in mind.

Second, a new set of consent revocation rules set to take effect in April will massively alter calling strategy and result in brands losing the ability to contact consumers as “stop” requests will be applied across channel and purpose - with only a limited ability to refine potential opt outs.

Plus, case law continues to rapidly expand the scope of the TCPA as the FCC and state-level regulators leverage everchanging theories to catch callers unaware.

With billions in penalties on the line for institutions that fail to comply, this session could literally save your business. It is a true must attend!
