THE LATEST ON AI

Generative AI (GenAI) raises novel issues across multiple legal and regulatory areas, including copyright, advertising, licensing, right of publicity, and more. Numerous litigations testing these issues are working their way through the courts. Meanwhile, regulators and legislatures around the world are scrambling to issue guidance and write new laws. Industry must balance the benefits of GenAI against potentially serious risks. We will discuss the current state of the GenAI legal and regulatory environment, and provide some practical guidance on risk-based approaches to thread the GenAI compliance needle.

TRENDS IN ESG ADVERTISING CLAIMS: WHAT ADVERTISERS SHOULD EXPECT IN THE U.S. AND IN CROSS-BORDER CAMPAIGNS

With the anticipated revisions to the Federal Trade Commission’s Green Guides looming, along with their expected impact on the level of substantiation required of advertisers making ESG claims, the focus and scrutiny on environmental and sustainability marketing and advertising has only increased. In addition, the number of consumer class action lawsuits against marketers for their use of misleading ESG claims has reached an all-time high. This session will consider the forthcoming revisions to the Green Guides and their impact on U.S. advertising and cross-border campaigns, trends in consumer class action lawsuits, and the line between aspirational and actionable ESG claims.

CLAIM SUBSTANTIATION: COMMON ISSUES IN STUDY DESIGN THAT TRIP ADVERTISERS UP

Companies often rely on R&D and scientists to design studies that will support their advertising claims. But what happens when there is a disconnect between those studies and the legal standards? We review issues in study design that frequently arise when they are put to the test in a legal challenge, including for example when a control is and is not necessary, when bridging of study results is and is not acceptable, and the statistics behind properly substantiating equivalence claims and ratio claims.
